Welcome to BetYou! These Terms of Service ("Terms") govern your access to and use of the BetYou mobile application (the "App" or "Service"). Please read these Terms carefully before using BetYou.

1. Acceptance of Terms

By accessing or using BetYou, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you are using BetYou on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

BetYou is a social mobile application that allows users to create and track friendly predictions and bets with friends. The Service enables users to:

• Create groups with friends
• Make predictions about everyday events (bets)
• Vote on predictions
• Track statistics and leaderboards
• Connect with friends through friend requests
• Share profiles via links

3. Eligibility

3.1 Age Requirements

You must be at least 18 years old to use BetYou. By using BetYou, you represent that you meet these age requirements.

3.2 Account Limitations

You may only create one account. You may not create an account on behalf of another person or entity without proper authorization.

4. Account Registration and Security

4.1 Account Creation

To use BetYou, you must create an account by providing:

• A valid email address
• A unique username
• A display name
• A secure password

You agree to provide accurate, current, and complete information and to keep this information up to date.

4.2 Username Policy

Usernames must:

• Be unique and not already in use
• Not impersonate another person or entity
• Not contain offensive, inappropriate, or misleading content
• Not violate any trademark or intellectual property rights

We reserve the right to reclaim usernames that violate these policies or are inactive for extended periods.

4.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. User Conduct and Prohibited Activities

5.1 Acceptable Use

You agree to use BetYou only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use and enjoyment of the Service.

5.2 Prohibited Activities

You agree NOT to:

• Harass or abuse: Harass, threaten, intimidate, or bully other users
• Post inappropriate content: Create bets or content that is offensive, hateful, discriminatory, sexually explicit, or violent
• Spam: Send unsolicited messages, advertisements, or spam
• Real-money gambling: Use BetYou for any form of real-money gambling or wagering
• Impersonate: Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Violate laws: Violate any applicable local, state, national, or international law
• Interfere with Service: Interfere with or disrupt the Service or servers or networks connected to the Service
• Exploit vulnerabilities: Attempt to gain unauthorized access to any portion of the Service, other accounts, or systems
• Scrape data: Use automated means (bots, scrapers, crawlers) to access the Service or collect data
• Reverse engineer: Reverse engineer, decompile, or disassemble any aspect of the Service
• Create fake accounts: Create multiple accounts or fake accounts
• Sell accounts: Sell, trade, or transfer your account to another person

5.3 Content Standards

All content you create (bet questions, group names, display names) must:

• Be respectful and appropriate for a general audience
• Not contain personal information of others without consent
• Not infringe on intellectual property rights
• Not contain false or misleading information
• Comply with all applicable laws

6. Betting Rules and Mechanics

6.1 Nature of Bets

All bets on BetYou are:

• For entertainment purposes only
• Not for real money, goods, or services
• Based on friendly predictions between friends
• Tracked for statistics and bragging rights only

6.2 Bet Creation and Voting

• Group members can create bets within their groups
• Each user can vote once per bet
• Votes cannot be changed once submitted
• The bet creator determines the correct outcome
• All bet creators must close bets in good faith with the accurate outcome

6.3 Bet Disputes

If there is a dispute about a bet outcome:

• Users should resolve disputes amongst themselves
• BetYou does not mediate bet disputes
• Users can remove members from groups if needed
• Repeated bad-faith bet closures may result in account suspension

7. Groups and Social Features

7.1 Group Creation and Management

• Groups must have a minimum of 2 members and maximum of 15 members
• All group members have equal permissions to add or remove members
• Any member can leave a group at any time
• Removed members lose access to group content but their historical contributions remain

7.2 Friend Connections

• Users can send friend requests to other users
• Friend requests must be accepted by the recipient
• Either party can remove the friendship at any time

7.3 Profile Sharing

• Public profile information includes username, display name, and overall statistics
• Group memberships are private and not visible on public profiles
• You are responsible for who you share your profile link with

8. Intellectual Property Rights

8.1 BetYou's Rights

BetYou and its licensors own all rights, title, and interest in and to the Service, including all intellectual property rights. This includes:

• The BetYou name, logo, and branding
• The app design, interface, and user experience
• All software, code, and technology
• All content we create

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

8.2 Your Content

You retain ownership of content you create in BetYou (bet questions, group names, etc.). However, by posting content to the Service, you grant BetYou a worldwide, non-exclusive, royalty-free license to:

• Use, copy, reproduce, process, and adapt your content
• Display your content to other users as necessary to provide the Service
• Store and back up your content

This license ends when you delete your content or account, except where content has been shared with others and they have not deleted it, or where we are required to retain it for legal reasons.

8.3 Feedback

If you provide feedback, suggestions, or ideas about BetYou, you grant us the right to use and incorporate that feedback without any obligation to compensate you.

9. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using BetYou, you consent to our collection and use of data as described in the Privacy Policy.

10. Push Notifications

By enabling push notifications, you consent to receiving notifications from BetYou about:

• New bets in your groups
• Closed bets and results
• Friend requests
• Other app activities

You can disable push notifications at any time in your device settings.

11. Termination

11.1 Your Right to Terminate

You may delete your account at any time through the app settings. Deleting your account will:

• Remove you from all groups
• Delete your profile information
• Remove your active votes
• Anonymize your historical contributions

11.2 Our Right to Terminate

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in prohibited activities
• Your account has been inactive for an extended period
• We need to comply with legal requirements
• Continuing to provide the Service to you would create substantial risk for us

We will provide notice of termination when possible, but we reserve the right to terminate immediately for severe violations.

11.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your data in accordance with our data retention policies
• Provisions that should survive termination will continue to apply

12. Disclaimers and Limitations of Liability

12.1 "AS IS" Disclaimer

BetYou is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or availability

We do not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results obtained from the Service will be accurate or reliable

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETYOU AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Unauthorized access to or alteration of your content
• Statements or conduct of any third party on the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, OR $100 USD, WHICHEVER IS GREATER.

12.3 User Disputes

You are solely responsible for your interactions with other users. We reserve the right, but have no obligation, to monitor disputes between you and other users. We will not be liable for your interactions with other users or for any user's action or inaction.

13. Indemnification

You agree to defend, indemnify, and hold harmless BetYou and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another
• Content you post to the Service

14. Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Add or remove features
• Impose limits on certain features
• Restrict access to parts or all of the Service

We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the app
• Updating the "Last Updated" date
• Sending you a notification through the app or email

Your continued use of BetYou after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of [YOUR STATE], United States, without regard to its conflict of law provisions.

16.2 Dispute Resolution

For any dispute arising from these Terms or the Service:

1. Informal Resolution: You agree to first contact us at support@bnormillapps.com to attempt to resolve the dispute informally
2. Arbitration: If we cannot resolve the dispute informally within 60 days, either party may initiate binding arbitration under the rules of the American Arbitration Association
3. Location: Any arbitration will take place in New york
4. Class Action Waiver: You agree to arbitrate disputes on an individual basis only, and not as part of any class or representative action

16.3 Exceptions

Either party may bring suit in court for:

• Injunctive relief
• Intellectual property disputes
• Small claims court matters (if eligible)

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BetYou regarding the Service.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

17.5 Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.

17.6 Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or internet outages.

17.7 Export Controls

The Service may be subject to export laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations.

17.8 Apple-Specific Terms

If you access the Service through an iOS device:

• These Terms are between you and BetYou, not Apple, and Apple is not responsible for the Service
• Apple has no obligation to provide maintenance or support for the Service
• Apple is not responsible for addressing any claims relating to the Service
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with Apple's App Store Terms of Service

Acknowledgment: By using BetYou, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
